Terms of service

The terms that govern your use of Root, written to be read.

Agreement

These terms are an agreement between you and Mekanism AI LLC, the company that operates Root. They apply when you create an account, access the service, or use Root in any way. If you are agreeing on behalf of a business, you confirm that you are authorized to bind that business to these terms. If you do not agree to these terms, do not use Root.

The service

Root is operational software for running a business. It is provided on a subscription basis, delivered over the internet, and accessed through a web browser and supported apps. Different features and modules turn on depending on the plan you are on. We add to and improve the service over time, and we may change or remove features. If a change materially reduces a core part of the service you rely on, we will give you reasonable notice.

Accounts and your responsibilities

You are responsible for the accounts you and your team use. Keep your login credentials secure and do not share them beyond the people you authorize. Give us accurate account and billing information and keep it current. You are responsible for everything done under your accounts, and for making sure the people you give access to follow these terms. Tell us promptly if you believe an account has been used without your permission.

Acceptable use

Use Root for running your business and nothing unlawful. Do not use the service to break the law, infringe someone else's rights, or send content you have no right to send. Do not attempt to interfere with the platform, get around its limits or security, overload it, or access parts of it you have not been given access to. Do not copy, resell, or reverse engineer the software except where the law expressly allows it. We may suspend access that puts the platform, your data, or other customers at risk.

Payments and billing

Paid plans are billed on a recurring subscription basis at the rate shown when you sign up or as we agree with you in writing. Fees are charged in advance for each billing period and, unless stated otherwise, are not refundable for a period already started. Payments are handled by a third-party payment processor, and using the service means agreeing to that processor's terms as well. Stated prices do not include taxes; you are responsible for any taxes that apply, other than taxes on our income. If a payment fails or an account falls past due, we may suspend paid features until it is resolved.

Your data and ownership

Your data is yours. You keep all rights to the information, content, and records you put into Root. You grant us only the rights we need to operate the service for you, such as storing, processing, backing up, and displaying your data so the product works, and so we can support you and keep it secure. We never use your data to train AI models. We handle your data as described in our Privacy policy, which is part of these terms. You can export your data and ask us to delete it as set out there.

Availability

We work hard to keep Root reliable and fast, because the software is only useful if it is there when the room is full. That said, the service is provided as it is and as available. We do not promise a specific uptime figure in these terms. There may be times when the service is down for maintenance, updates, or reasons outside our control. We aim to keep planned downtime short and, where we can, to schedule it considerately.

Disclaimers

Root is provided without warranties of any kind, whether stated or implied, to the extent the law allows. We do not promise that the service will be uninterrupted, error free, or fit for a particular purpose, and we are not responsible for decisions you make based on what the software shows you. You are responsible for keeping your own records as your business and the law require.

Limitation of liability

To the extent the law allows, neither party is liable to the other for indirect, incidental, or consequential losses, or for lost profits, revenue, goodwill, or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim. Some of these limits may not apply where the law does not allow them; in that case, our liability is limited to the least the law permits.

Termination

You can stop using Root and cancel your subscription at any time. We may suspend or end your access if you breach these terms, if your account is past due, or if we are required to by law. If your account ends, your right to use the service ends with it. For a reasonable period after termination you can export your data, after which we may delete it in line with our Privacy policy. The parts of these terms that should survive ending the agreement, such as payment owed, ownership, disclaimers, and limits on liability, will continue to apply.

Changes to these terms

We may update these terms as the product and the law change. When we make a material change, we will update the date at the top of this page and, where appropriate, let you know in the product or by email. If you keep using Root after a change takes effect, that means you accept the updated terms. If you do not agree with a change, your option is to stop using the service.

Governing law and contact

These terms are governed by the laws that apply to Mekanism AI LLC, and any dispute relating to them or to the service will be handled under those laws. If any part of these terms is found unenforceable, the rest stays in effect. Questions about these terms are welcome. Email us and a person will reply.
